IMMIGRATION LAW IN AFGHANISTAN

VISA REQUIREMENTS

Countries Requiring Visas:

All persons entering Afghanistan, except the following require visas:

  • travelers holding a re-entry permit issued by Afghanistan;
  • transit passengers who are not leaving the airport and continuing their journey within 2 hours.

Types of Visa and Validity:

1. Tourist Visa: This is valid for 30 days and is issued for the purpose of visiting Afghanistan.

2. Transit Visa: This is valid for 72 hours for air passengers and 6 days for persons traveling by land.

3. Resident Visa: This is valid from 1 month to 6 months.

4. Entry Visa for Work Permit: This is issued for business, economic, commercial, cultural, industrial purposes and working for the governmental and non governmental organizations.

5. Diplomatic Visa: This is issued to travelers holding diplomatic passports.

6. Service visa: This is issued to holders of service or special passports.

7. Student Visa: This is issued to foreign students intending to study in Afghanistan.

8. Exit Visa: This is valid from 1 day to 6 days and is issued to foreign nationals who have entered Afghanistan with entry work permit visa.

Visa Charges:

Single Entry: ₤30.00

Double Entry: ₤40.00

Multiple Entry (up to 3 months): ₤55.00

Multiple Entry (up to 6 months): ₤115.00

Documents Required for Visa Application:

The following documents are required while applying for a Visa:

  • Completed Application Form;
  • Passport valid for at least 6 months;
  • One Passport-sized photograph;
  • Return or onward ticket and documents required for onward journey;
  • Proof of sufficient funds to cover stay in Afghanistan;
  • Visa Fee payable by cash, postal order or cheque;
  • A registered self-addressed envelope for postal applications.

 

Along with the above documents the following documents are also required as per the visa type:

For Business visits:

  • Letter of introduction from the employer or sponsor stating the purpose and duration of the applicant’s trip;
  • A guarantee of financial responsibility from the company.

For Tourist Visas:

  • Letter of invitation from the host in Afghanistan;
  • Copy of round trip airline tickets or itinerary.

AFGHANISTAN CITIZENSHIP

A person may acquire citizenship of Afghanistan through one of the following methods:

1. By Birth: A child born within the territory of Afghanistan acquires citizenship by birth if:

· the child is of unknown parentage or whose parents are stateless;

· the child’s parents are foreign nationals, provided one parent was born and continuously lived in Afghanistan;

· the child’s either or both parents are foreign nationals and the child continues to live in Afghanistan until he / she attains 18 years of age. 

2. By Descent: A person can acquire citizenship of Afghanistan by descent if either of his / her parents is a citizen of Afghanistan, irrespective of the person’s place of birth.

3. By Marriage: A person whose spouse is a citizen of Afghanistan can himself / herself acquire citizenship of Afghanistan.

4. By Naturalization: A person can acquire citizenship of Afghanistan by naturalization if he / she fulfills the following conditions:

· has attained 18 years of age;

· has resided in Afghanistan for a continuous period of 5 years;

· has not been involved in any major crime.
