IMMIGRATION LAW IN AZERBAIJAN

The Consulate General of the Republic of Azerbaijan issues the various types of visas to Azerbaijan. Citizens of countries of the Commonwealth of Independent States (CIS) (ListOfCommonwealthOfIndependentStates.doc) other than Azerbaijan do not need a visa to enter Azerbaijan. A person having a visa for another CIS country will be allowed to stay in Azerbaijan for 24 hours without having a visa. Citizens of Turkmenistan, which is an associate member of CIS countries, require a visa. Georgian visas are valid for transit through Azerbaijan for a period of up to 5 days.

According to Azerbaijani law, foreign nationals intending to remain in Azerbaijan for more than 30 days are required to register with local police within three days of their arrival.

TYPES OF VISA

The main types of visas issued by the Consular Department of the Ministry of Foreign Affairs of Azerbaijan are the Tourist, Private, Business and Transit Visas. These visas are of the following kinds depending upon their category:

  • Single and Double Entry-Exit Visa: This is valid from 3 days to 3 months.

 

  • Multiple Entry-Exit Visa: This visa allows the visa holder to stay in Azerbaijan for a period of 1 year. Non-use of this visa makes it invalid. They are available only for Business or Private Visits.

 

  • Exit Visa: A foreign national having an official permission to live in Azerbaijan can obtain this visa upon leaving the country after they have complied with the appropriate rules on residency in Azerbaijan. No state duty is charged on this visa.

 

  • Return Visa: It is granted to foreign nationals pursuing studies, research or teaching activity in Azerbaijan. Foreigners who have a personal passport, upon leaving the country can obtain it to return for a period of up to 1 month. This visa is valid for 6 months and it becomes invalid if it is not used within 6 months from the date of exit from Azerbaijan.

 

A Transit Visa containing no notes or seals about non-stop passage gives the visa holder the right to stay in Azerbaijan for no longer than 5 days.


DOCUMENTS REQUIRED FOR VISA APPLICATION

The following documents are required for obtaining a visa at the Consular Department of the Ministry of Foreign Affairs of Azerbaijan:

  • A completed standard Visa Application form signed by the applicant;
  • Original passport or travel document;
  • Two passport-size photographs;
  • A Visa fee receipt.

In addition to the above documents, the following documents are also required as per the visa type:

For Tourist Visa: An invitation letter from a travel agency in Azerbaijan or evidence of confirmed hotel reservation.

For Private Visa: An invitation letter from a person resident in Azerbaijan.

For Business Visa: An invitation letter from a company registered in Azerbaijan.

For Transit Visa: A confirmed onward travel documentation and valid entry requirements for onward destination.

The invitation letters should be sent through the Consular Department of the Ministry of Foreign Affairs of Azerbaijan.

WHERE TO OBTAIN VISA

The foreign nationals who are traveling to Azerbaijan can obtain their visa at Azerbaijan’s Embassies abroad.

A person traveling by air, who does not obtain a visa abroad can get a single entry-exit visa for a short duration of stay at Heydar Aliyey International airport upon arrival.

VISA CHARGES

The cost of visas differs according to their category. The only acceptable forms of payment are Money Orders or Certified Bank Checks payable to the Consulate General of Azerbaijan. The current consular fees are:

 

Transit single entry (valid for 3 days) - 20 US dollars.

Transit double entry (valid for 3 days) - 40 US dollars.

Single entry visa (valid for 3 months) - 40 US dollars.

Double entry visa (valid for 3 months) – 80 US dollars.

Multiple entry visa (valid for 1 year) – 250 US dollars.

AZERBAIJAN CITIZENSHIP

Eligibility Requirements:

A person born in the territory of the Azerbaijan Republic, or by a citizen of the

Azerbaijan Republic, or one of whose parents is a citizen of the Azerbaijan Republic shall become a citizen of the Azerbaijan Republic. Moreover, the following persons are considered citizens of the Azerbaijan Republic:

  • Persons who had citizenship of the Azerbaijan Republic before up to the day of enactment of the law on citizenship of the Azerbaijan Republic;
  • Stateless persons who had been registered in a place of residence in Azerbaijan until January 1, 1992 if they applied for citizenship within 1 year from the day of enactment of the law on citizenship;
  • Refugees who have been settled in Azerbaijan from January 1, 1988 until January 1, 1992;
  • Persons who are admitted to the citizenship in accordance with Azerbaijan’s law on citizenship.
  • Persons who obtained the citizenship on the grounds provided by international treaties of the Azerbaijan Republic or other grounds provided by the law.

The following basic criteria is required for a foreigner or stateless person to be admitted to Azerbaijan’s citizenship:

 

  • 5 years of residence in Azerbaijan; and
  • the knowledge of the State language.

The following children are considered citizens of Azerbaijan:

<!--[if !supportLists]-->· <!--[endif]-->children belonging to stateless persons and born in the territory of the Azerbaijan Republic; and

<!--[if !supportLists]-->· <!--[endif]-->children whose both parents are unknown, and who are located in the territory of the Azerbaijan Republic.

Documents proving citizenship:

The following documents prove Azerbaijan’s citizenship:

  • birth certificate;
  • identification document of an Azerbaijan’s citizen;
  • passport of an Azerbaijan’s citizen.

Termination of Citizenship

The citizenship of the Azerbaijan Republic shall be terminated if:

 

  • the citizenship is dropped by a person;
  • the citizenship is forfeited due to submission of falsified document for acquiring the citizenship;
  • there are grounds provided by international treaties of the Azerbaijan Republic;
  • there are other grounds provided by Azerbaijan’s law on citizenship.

Retention Of Citizenship:

The citizenship of the Azerbaijan Republic shall be retained in the following cases:

 

  • Settlement or dissolution of marriage between male or female citizen of the Azerbaijan Republic and a foreigner or a stateless person;
  • Change in the citizenship of one of the spouse shall not change the citizenship of the other spouse;
  • Residence of a citizen of the Azerbaijan Republic in the territory of a foreign state.

Children’s citizenship:

<!--[if !supportLists]-->· <!--[endif]-->If one or both of the parents change their citizenship and acquire the citizenship of the Azerbaijan Republic, their children under the age of 14 shall be provided with Azerbaijan’s citizenship.

<!--[if !supportLists]-->· <!--[endif]-->If one or both of the parents drop their Azerbaijan’s citizenship and do not participate in raising the child upon whom a guardianship or custody was appointed, then the child’s Azerbaijan’s citizenship shall be retained upon application by parents, guardian or custodian.

<!--[if !supportLists]-->· <!--[endif]-->If one of a child’s parents has acquired Azerbaijan’s citizenship and the other parent is a foreigner or a stateless person, then this child may acquire the citizenship of the Azerbaijan Republic upon application of the parent, who has got Azerbaijan’s citizenship, and with consent of the other parent, who is a foreigner or stateless person.

<!--[if !supportLists]-->· <!--[endif]-->If the citizenship of one of a child’s parents is terminated, but the other

parent remains Azerbaijan’s citizen, then this child shall retain Azerbaijan’s citizenship. The child may be allowed to drop Azerbaijan’s citizenship upon application by the parent, whose citizenship has been terminated, and with consent of the other parent, who has retained the citizenship.

Adoption by Azerbaijan’s citizens:

  • If Azerbaijan’s citizens adopt a foreign or a stateless child, then this child shall acquire Azerbaijan’s citizenship.
  • If one of the spouses, who adopt a foreign or a stateless child, is a citizen of the Azerbaijan Republic, and the other one is a foreigner or a stateless person, then this child shall be provided with Azerbaijan’s citizenship.

The child shall acquire the citizenship upon agreement of persons who adopt the child.

 

Adoption by Foreigners and stateless persons:

  • If foreigners adopt a child who is an Azerbaijan’s citizen, the citizenship of this child may be terminated upon application by persons, who adopt this child.
  • If one of the spouses, adopting a child citizen of the Azerbaijan Republic, is the citizen of the Azerbaijan Republic, and the other one is a foreigner, then the adopted child shall retain the citizenship of the Azerbaijan Republic. This child may drop the citizenship of the Azerbaijan Republic upon application by persons, who adopt him/her.
  • If both of the spouses, adopting a child citizen of the Azerbaijan Republic, are stateless persons, then this child shall retain the citizenship of the Azerbaijan

Republic.

  • If one of the spouses, who adopt a child citizen of the Azerbaijan Republic,

is the citizen of the Azerbaijan Republic, and the other one is a stateless person, then this child shall retain the citizenship of the Azerbaijan Republic.

Child’s Consent:

The citizenship of children between the ages of 14-18 may be changed only with their consent.

<!--[if !supportLists]-->· <!--[endif]-->If one of a child’s parents has acquired Azerbaijan’s citizenship and the other parent is a foreigner or a stateless person, then this child may acquire the citizenship of the Azerbaijan Republic upon application of the parent, who has got Azerbaijan’s citizenship, and with consent of the other parent, who is a foreigner or stateless person.

parent remains Azerbaijan’s citizen, then this child shall retain Azerbaijan’s citizenship. The child may be allowed to drop Azerbaijan’s citizenship upon application by the parent, whose citizenship has been terminated, and with consent of the other parent, who has retained the citizenship.

Adoption by Azerbaijan’s citizens:

  • If Azerbaijan’s citizens adopt a foreign or a stateless child, then this child shall acquire Azerbaijan’s citizenship.
  • If one of the spouses, who adopt a foreign or a stateless child, is a citizen of the Azerbaijan Republic, and the other one is a foreigner or a stateless person, then this child shall be provided with Azerbaijan’s citizenship.

The child shall acquire the citizenship upon agreement of persons who adopt the child.

 

Adoption by Foreigners and stateless persons:

  • If foreigners adopt a child who is an Azerbaijan’s citizen, the citizenship of this child may be terminated upon application by persons, who adopt this child.
  • If one of the spouses, adopting a child citizen of the Azerbaijan Republic, is the citizen of the Azerbaijan Republic, and the other one is a foreigner, then the adopted child shall retain the citizenship of the Azerbaijan Republic. This child may drop the citizenship of the Azerbaijan Republic upon application by persons, who adopt him/her.
  • If both of the spouses, adopting a child citizen of the Azerbaijan Republic, are stateless persons, then this child shall retain the citizenship of the Azerbaijan

Republic.

  • If one of the spouses, who adopt a child citizen of the Azerbaijan Republic,

is the citizen of the Azerbaijan Republic, and the other one is a stateless person, then this child shall retain the citizenship of the Azerbaijan Republic.

Child’s Consent:

The citizenship of children between the ages of 14-18 may be changed only with their consent.

IMMIGRATION LAW IN AZERBAIJAN

The Consulate General of the Republic of Azerbaijan issues the various types of visas to Azerbaijan. Citizens of countries of the Commonwealth of Independent States (CIS) (ListOfCommonwealthOfIndependentStates.doc) other than Azerbaijan do not need a visa to enter Azerbaijan. A person having a visa for another CIS country will be allowed to stay in Azerbaijan for 24 hours without having a visa. Citizens of Turkmenistan, which is an associate member of CIS countries, require a visa. Georgian visas are valid for transit through Azerbaijan for a period of up to 5 days.

According to Azerbaijani law, foreign nationals intending to remain in Azerbaijan for more than 30 days are required to register with local police within three days of their arrival.

TYPES OF VISA

The main types of visas issued by the Consular Department of the Ministry of Foreign Affairs of Azerbaijan are the Tourist, Private, Business and Transit Visas. These visas are of the following kinds depending upon their category:

  • Single and Double Entry-Exit Visa: This is valid from 3 days to 3 months.

 

  • Multiple Entry-Exit Visa: This visa allows the visa holder to stay in Azerbaijan for a period of 1 year. Non-use of this visa makes it invalid. They are available only for Business or Private Visits.

 

  • Exit Visa: A foreign national having an official permission to live in Azerbaijan can obtain this visa upon leaving the country after they have complied with the appropriate rules on residency in Azerbaijan. No state duty is charged on this visa.

 

  • Return Visa: It is granted to foreign nationals pursuing studies, research or teaching activity in Azerbaijan. Foreigners who have a personal passport, upon leaving the country can obtain it to return for a period of up to 1 month. This visa is valid for 6 months and it becomes invalid if it is not used within 6 months from the date of exit from Azerbaijan.

 

A Transit Visa containing no notes or seals about non-stop passage gives the visa holder the right to stay in Azerbaijan for no longer than 5 days.


DOCUMENTS REQUIRED FOR VISA APPLICATION

The following documents are required for obtaining a visa at the Consular Department of the Ministry of Foreign Affairs of Azerbaijan:

  • A completed standard Visa Application form signed by the applicant;
  • Original passport or travel document;
  • Two passport-size photographs;
  • A Visa fee receipt.

In addition to the above documents, the following documents are also required as per the visa type:

For Tourist Visa: An invitation letter from a travel agency in Azerbaijan or evidence of confirmed hotel reservation.

For Private Visa: An invitation letter from a person resident in Azerbaijan.

For Business Visa: An invitation letter from a company registered in Azerbaijan.

 

For Transit Visa: A confirmed onward travel documentation and valid entry requirements for onward destination.

The invitation letters should be sent through the Consular Department of the Ministry of Foreign Affairs of Azerbaijan.

WHERE TO OBTAIN VISA

The foreign nationals who are traveling to Azerbaijan can obtain their visa at Azerbaijan’s Embassies abroad.

A person traveling by air, who does not obtain a visa abroad can get a single entry-exit visa for a short duration of stay at Heydar Aliyey International airport upon arrival.

VISA CHARGES

The cost of visas differs according to their category. The only acceptable forms of payment are Money Orders or Certified Bank Checks payable to the Consulate General of Azerbaijan. The current consular fees are:

 

Transit single entry (valid for 3 days) - 20 US dollars.

Transit double entry (valid for 3 days) - 40 US dollars.

Single entry visa (valid for 3 months) - 40 US dollars.

Double entry visa (valid for 3 months) – 80 US dollars.

Multiple entry visa (valid for 1 year) – 250 US dollars.

AZERBAIJAN CITIZENSHIP

Eligibility Requirements:

A person born in the territory of the Azerbaijan Republic, or by a citizen of the

Azerbaijan Republic, or one of whose parents is a citizen of the Azerbaijan Republic shall become a citizen of the Azerbaijan Republic. Moreover, the following persons are considered citizens of the Azerbaijan Republic:

  • Persons who had citizenship of the Azerbaijan Republic before up to the day of enactment of the law on citizenship of the Azerbaijan Republic;
  • Stateless persons who had been registered in a place of residence in Azerbaijan until January 1, 1992 if they applied for citizenship within 1 year from the day of enactment of the law on citizenship;
  • Refugees who have been settled in Azerbaijan from January 1, 1988 until January 1, 1992;
  • Persons who are admitted to the citizenship in accordance with Azerbaijan’s law on citizenship.
  • Persons who obtained the citizenship on the grounds provided by international treaties of the Azerbaijan Republic or other grounds provided by the law.

The following basic criteria is required for a foreigner or stateless person to be admitted to Azerbaijan’s citizenship:

 

  • 5 years of residence in Azerbaijan; and
  • the knowledge of the State language.

The following children are considered citizens of Azerbaijan:

<!--[if !supportLists]-->· <!--[endif]-->children whose both parents are unknown, and who are located in the territory of the Azerbaijan Republic.

Documents proving citizenship:

The following documents prove Azerbaijan’s citizenship:

  • birth certificate;
  • identification document of an Azerbaijan’s citizen;
  • passport of an Azerbaijan’s citizen.

Termination of Citizenship

The citizenship of the Azerbaijan Republic shall be terminated if:

 

  • the citizenship is dropped by a person;
  • the citizenship is forfeited due to submission of falsified document for acquiring the citizenship;
  • there are grounds provided by international treaties of the Azerbaijan Republic;
  • there are other grounds provided by Azerbaijan’s law on citizenship.

Retention Of Citizenship:

The citizenship of the Azerbaijan Republic shall be retained in the following cases:

 

  • Settlement or dissolution of marriage between male or female citizen of the Azerbaijan Republic and a foreigner or a stateless person;
  • Change in the citizenship of one of the spouse shall not change the citizenship of the other spouse;
  • Residence of a citizen of the Azerbaijan Republic in the territory of a foreign state.

<!--[if !supportLists]-->· <!--[endif]-->If one or both of the parents drop their Azerbaijan’s citizenship and do not participate in raising the child upon whom a guardianship or custody was appointed, then the child’s Azerbaijan’s citizenship shall be retained upon application by parents, guardian or custodian.
