IMMIGRATION LAW IN INDONESIA

VISA REQUIREMENTS

Countries Requiring Visas:

The citizens of the following countries do not require a visa to enter Indonesia for tourist visits up to 30 days:

  • Brunei, Chile, Hong Kong (Special Administrative Region), Macao (Special Administrative Region), Malaysia, Morocco, Peru, Philippines, Singapore, Thailand and Vietnam;

The citizens of the following countries need an approval from the Indonesian Immigration Office before traveling for business, tourist or social visits:

  • Afghanistan, Albania, Angola, Bangladesh, Cameroon, Cuba, Ethiopia, Ghana, Iraq, Israel, Nigeria, North Korea, Pakistan, Somalia, Sri Lanka, Tanzania and Tonga.

The citizens of the following countries are issued with Short Visit Tourist Visas on arrival for staying up to 30 days:

  • Argentina, Australia, Austria, Bahrain, Belgium, Brazil, Bulgaria, Cambodia, Canada, China, Cyprus, Denmark, Egypt, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, India, Iran, Ireland, Italy, Japan, Kuwait, Laos, Liechtenstein, Luxembourg, Maldives, Malta, Mexico, Monaco, Netherlands, New Zealand, Norway, Oman, Poland, Portugal, Qatar, Russia, Saudi Arabia, South Africa, South Korea, Spain, Surinam, Sweden, Switzerland, Taiwan, United Arab Emirates, United Kingdom and United States of America.

Types of Visa, and Validity:

1. Diplomatic Visa: A Diplomatic Visa is issued to foreigners holding a Diplomatic or UN Laissez Passer passport for carrying out diplomatic assignments in Indonesia. It is valid for 3 months from the date of issuance.

2. Service / Official Visa: A Service Visa is issued to foreigners holding an official or service passport for carrying out assignments in Indonesia for non-diplomatic purposes. It is valid for 3 months from the date of issuance.

 

3. Visit Visa: The following are the different types of Visit visa:

 i. Business Visa: This is issued to foreigners visiting Indonesia for carrying out business related activities.

 

· Single Entry: This is valid for 3 months from the date of issuance and allows a maximum stay of 60 days.

 

· Multiple Entry: This is valid for 1 year from the date of issuance and allows a maximum stay of 60 days. This is issued upon authorization by the Indonesian Immigration Office.

 

 ii. Tourist Visa: This is issued to foreigners visiting Indonesia for holiday or leisure purposes.

 

· Single Entry: This is valid for 3 months from the date of issuance and allows a maximum stay of 60 days.

 

 iii. Social / Cultural Visit Visa: This is issued to foreigners visiting Indonesia for social or cultural visit such as for visiting relatives or friends, social organizations, exchange visits between educational institutions or for undertaking research and attending training programme in Indonesia.

 

· Single Entry: This is valid for 3 months from the date of issuance and allows a maximum stay of 60 days.

 

· Multiple Entry: This can be issued only upon a special permit from the Indonesian Immigration Office.

 

4. Limited Stay Period Visa: This is issued to foreigners visiting Indonesia for staying there for a limited period for foreign investment, employment, education, training or scientific research, religious duties, or for joining one’s Indonesian husband or parent or a foreigner holding a Limited Stay Permit. It is also called a Temporary Stay Permit.

 

· Single Entry: This is valid for 3 months from the date of issuance and allows a maximum stay of 1 year.

 

5. Transit Visa: This is issued to passengers continuing their journey to another country provided they are in possession of valid documentation to travel to their next destination. It is also issued to persons joining or working on a transport vehicle continuing its journey outside Indonesian territory provided such persons have proof of a work contract for the same.

 

· Single Entry: This is valid for 3 months from the date of issuance and allows a maximum stay of 7 days from the date of arrival in Indonesia.

 

Visa Charges:

1. Diplomatic Visa: This is issued free of charge.

2. Service / Official Visa: This is issued free of charge.

3. Visit Visa:

 i. Business Visa:

 

· Single Entry: £ 35

· Multiple Entry: £ 125

 ii. Tourist Visa: £ 35

 iii. Social / Cultural Visa: £ 35

4. Limited Stay Period Visa: £ 100

5. Transit Visa: £ 15

Documents Required for Visa Application:

The following documents are required while applying for a Visa:

 

  • Passport valid for at least 6 months from the date of entry into Indonesia;
  • Complete Application Form;
  • One passport-sized photograph;
  • Proof of sufficient funds to cover stay duration in Indonesia;
  • Visa Fee payable by cash or postal order only;
  • A self-addressed envelope for postal applications.

 

Along with the above documents the following documents are also required as per the visa type:

 

For Business Visa:

  • A letter from the applicant’s company in the home country and a letter from the Indonesian company stating the reason and duration of the visit and guarantee of financial responsibility and accommodation;
  • Passport valid for at least 1 year from the date of entry into Indonesia, for Multiple Entry Business Visa.

For Tourist Visa:

 

  • Travel itinerary;
  • Hotel reservation;
  • A letter (less than 1 month old) from applicant’s employer, or in case of self-employed applicants, a letter from a solicitor, accountant or bank manager certifying the applicant’s obligation to return to the country where he / she permanently resides;
  • In case of student applicants, a letter from school, college, or University confirming attendance.

 

For Social / Cultural Visa:

  • A letter of invitation from the applicant’s family, friends, relatives or social organizations in Indonesia stating the reason and duration of the visit and details of accommodation, and a photocopy of their passport or ID;
  • A letter from applicant’s employer, school or college certifying the applicant’s obligation to return to the country where he / she permanently resides;
  • A third party letter guaranteeing the applicant’s financial responsibility during the stay in Indonesia;
  • For those visiting Indonesia for undertaking study, training, or research, a letter of registration from the Indonesian school, college, or institution, verifying the duration and nature of the course, training or research and proof of payment of the requisite fees.

 

Limited Stay Period Visa:

  • Passport valid for at least 1 year from the date of entry into Indonesia;
  • A letter of invitation or support from the applicant’s sponsors;
  • A third party letter guaranteeing the applicant’s financial responsibility during the stay in Indonesia;
  • A letter from applicant’s employer, school or college certifying the applicant’s obligation to return to the country where he / she permanently resides;
  • A marriage certificate and / a birth certificate, for applicants joining an Indonesian husband or parent or a foreigner holding a Limited Stay Permit.

 

For Transit Visa:

  • Proof of a Work Contract;
  • Valid and confirmed tickets and other documents to travel to the applicant’s next destination.

INDONESIAN CITIZENSHIP

A person may acquire Indonesian citizenship through one of the following methods:

 

1. By Birth: The following persons can acquire Indonesian citizenship by birth:

 

· A person born in Indonesia between January 1, 1946 and August 1, 1958, irrespective of the nationality of his / her parents;

 

· A person born in Indonesia after August 1, 1958 of unknown parentage.

 

2. By Descent: A person can acquire Indonesian citizenship by descent if either of his / her parent is an Indonesian citizen, irrespective of the person’s place of birth.

 

3. By Marriage: A foreign woman can acquire Indonesian citizenship by marrying an Indonesian citizen and renouncing her former citizenship.

 

4. By Naturalization: A person can be naturalized as an Indonesian citizen upon fulfillment of the following conditions:

 

  • he / she has attained 21 years of age;
  • he / she has renounced former citizenship;
  • he / she has resided in Indonesia for a consecutive period of 5 years or for a period totaling 10 years if the stay has not been consecutive;
  • he / she has sufficient knowledge of the Indonesian language and the history of Indonesia;
  • he / she is of good character and has no criminal record;
  • he / she has a regular means of support in Indonesia.

Types of Visa, and Validity:

1. Diplomatic Visa: A Diplomatic Visa is issued to foreigners holding a Diplomatic or UN Laissez Passer passport for carrying out diplomatic assignments in Indonesia. It is valid for 3 months from the date of issuance.

2. Service / Official Visa: A Service Visa is issued to foreigners holding an official or service passport for carrying out assignments in Indonesia for non-diplomatic purposes. It is valid for 3 months from the date of issuance.

 

3. Visit Visa: The following are the different types of Visit visa:

 i. Business Visa: This is issued to foreigners visiting Indonesia for carrying out business related activities.

 

· Single Entry: This is valid for 3 months from the date of issuance and allows a maximum stay of 60 days.

 

· Multiple Entry: This is valid for 1 year from the date of issuance and allows a maximum stay of 60 days. This is issued upon authorization by the Indonesian Immigration Office.

 

 ii. Tourist Visa: This is issued to foreigners visiting Indonesia for holiday or leisure purposes.

 

· Single Entry: This is valid for 3 months from the date of issuance and allows a maximum stay of 60 days.

 

 iii. Social / Cultural Visit Visa: This is issued to foreigners visiting Indonesia for social or cultural visit such as for visiting relatives or friends, social organizations, exchange visits between educational institutions or for undertaking research and attending training programme in Indonesia.

 

· Single Entry: This is valid for 3 months from the date of issuance and allows a maximum stay of 60 days.

 

· Multiple Entry: This can be issued only upon a special permit from the Indonesian Immigration Office.

 

4. Limited Stay Period Visa: This is issued to foreigners visiting Indonesia for staying there for a limited period for foreign investment, employment, education, training or scientific research, religious duties, or for joining one’s Indonesian husband or parent or a foreigner holding a Limited Stay Permit. It is also called a Temporary Stay Permit.

 

· Single Entry: This is valid for 3 months from the date of issuance and allows a maximum stay of 1 year.

 

5. Transit Visa: This is issued to passengers continuing their journey to another country provided they are in possession of valid documentation to travel to their next destination. It is also issued to persons joining or working on a transport vehicle continuing its journey outside Indonesian territory provided such persons have proof of a work contract for the same.

 

· Single Entry: This is valid for 3 months from the date of issuance and allows a maximum stay of 7 days from the date of arrival in Indonesia.

 

Visa Charges:

1. Diplomatic Visa: This is issued free of charge.

2. Service / Official Visa: This is issued free of charge.

3. Visit Visa:

 i. Business Visa:

 

· Single Entry: £ 35

· Multiple Entry: £ 125

 ii. Tourist Visa: £ 35

 iii. Social / Cultural Visa: £ 35

4. Limited Stay Period Visa: £ 100

5. Transit Visa: £ 15

Documents Required for Visa Application:

The following documents are required while applying for a Visa:

 

  • Passport valid for at least 6 months from the date of entry into Indonesia;
  • Complete Application Form;
  • One passport-sized photograph;
  • Proof of sufficient funds to cover stay duration in Indonesia;
  • Visa Fee payable by cash or postal order only;
  • A self-addressed envelope for postal applications.

 

Along with the above documents the following documents are also required as per the visa type:

 

For Business Visa:

  • A letter from the applicant’s company in the home country and a letter from the Indonesian company stating the reason and duration of the visit and guarantee of financial responsibility and accommodation;
  • Passport valid for at least 1 year from the date of entry into Indonesia, for Multiple Entry Business Visa.

For Tourist Visa:

 

  • Travel itinerary;
  • Hotel reservation;
  • A letter (less than 1 month old) from applicant’s employer, or in case of self-employed applicants, a letter from a solicitor, accountant or bank manager certifying the applicant’s obligation to return to the country where he / she permanently resides;
  • In case of student applicants, a letter from school, college, or University confirming attendance.

 

For Social / Cultural Visa:

  • A letter of invitation from the applicant’s family, friends, relatives or social organizations in Indonesia stating the reason and duration of the visit and details of accommodation, and a photocopy of their passport or ID;
  • A letter from applicant’s employer, school or college certifying the applicant’s obligation to return to the country where he / she permanently resides;
  • A third party letter guaranteeing the applicant’s financial responsibility during the stay in Indonesia;
  • For those visiting Indonesia for undertaking study, training, or research, a letter of registration from the Indonesian school, college, or institution, verifying the duration and nature of the course, training or research and proof of payment of the requisite fees.

 

Limited Stay Period Visa:

  • Passport valid for at least 1 year from the date of entry into Indonesia;
  • A letter of invitation or support from the applicant’s sponsors;
  • A third party letter guaranteeing the applicant’s financial responsibility during the stay in Indonesia;
  • A letter from applicant’s employer, school or college certifying the applicant’s obligation to return to the country where he / she permanently resides;
  • A marriage certificate and / a birth certificate, for applicants joining an Indonesian husband or parent or a foreigner holding a Limited Stay Permit.

 

For Transit Visa:

  • Proof of a Work Contract;
  • Valid and confirmed tickets and other documents to travel to the applicant’s next destination.

INDONESIAN CITIZENSHIP

A person may acquire Indonesian citizenship through one of the following methods:

 

1. By Birth: The following persons can acquire Indonesian citizenship by birth:

 

· A person born in Indonesia between January 1, 1946 and August 1, 1958, irrespective of the nationality of his / her parents;

 

· A person born in Indonesia after August 1, 1958 of unknown parentage.

 

2. By Descent: A person can acquire Indonesian citizenship by descent if either of his / her parent is an Indonesian citizen, irrespective of the person’s place of birth.

 

3. By Marriage: A foreign woman can acquire Indonesian citizenship by marrying an Indonesian citizen and renouncing her former citizenship.

 

4. By Naturalization: A person can be naturalized as an Indonesian citizen upon fulfillment of the following conditions:

 

  • he / she has attained 21 years of age;
  • he / she has renounced former citizenship;
  • he / she has resided in Indonesia for a consecutive period of 5 years or for a period totaling 10 years if the stay has not been consecutive;
  • he / she has sufficient knowledge of the Indonesian language and the history of Indonesia;
  • he / she is of good character and has no criminal record;
  • he / she has a regular means of support in Indonesia.
