Immigration And Visa Law Sweden
IMMIGRATION AND VISA
 
The word has its origin from the word migration. The word migration stands for migration and resettlement of people within countries or between countries. Migration from one's own country to resettle in the some other country is termed as emigration. If some foreign national migrates to your country to resettle in your country is called as immigration. The term resettlement means both forced resettlement for flight or expulsion and voluntary resettlement for the purpose of studies, of finding a better job or of being reunited with a beloved family or husband/wife.
 
The Sweden immigration is governed by the Migration Policy . The policy is based on a holistic approach, which ranges over several different areas and embraces refugee, immigration and integration policies, voluntary return to the country of origin and support to voluntary returnees. The policy is also a part of foreign policy, security policy, trade policy, foreign aid policy. The policy covers the aspects of human rights, which represent the very basis for the right of asylum, international cooperation and measures to prevent involuntary migration as well as to facilitate cross-border mobility in an organized manner.

IMMIGRATION AUTHORITIES
 
The principal authorities who are responsible for implementation of immigration laws are Migration Board and the Aliens Appeal Board.
  1. Migration Board
    In Sweden the Migration Board has been established which determines the standard practice for the granting of visas to citizens of different countries. The members of the Executive Committee of the Board are appointed by the Government and include representatives of the parliamentary parties. The board functions as per the decisions of the Riksdag and the Government and by pattern setting decisions taken by the Government and the Aliens Appeals Board.
  1. The Aliens Appeals Board
    The Aliens Appeals Board (Utlänningsnämnden) considers all appeals against decisions taken by the Migration Board except the visa decisions. Its rulings establish standard practice and serve as guidance for our decisions in this field.
  1. The Parliament
    The Parliament is responsible for migration policy decisions in Sweden pertaining to both immigration and return migration and to Swedish citizenship and passes the laws that the Migration Board is required to implement.
  1. The Government
    The Government here means the Ministry for Foreign Affairs and the Ministry of Industry, Employment and Communications, which supports the laws with ordinances describing particular situations.
VISA REQUIREMENTS
  1. Required Documents
    The following documents are required to be submitted by each applicant:
    1. Visa Application Form, completed and signed
    2. Passport- valid at least 3 months beyond stay
    3. Passport-type photographs required
    4. Completed Cover Page (print from browser)
    5. Airline tickets or confirmed itinerary Proof of sufficient funds
    6. Original letter of employment or 3 recent pay stubs.
    7. Proof establishing the purpose of your trip
    8. Proof of health/travel/accident insurance
    9. Photographs must be 2x2 inches in size, taken within the past 6 months.
    10. The image size from the bottom of the chin to the top of the head should be between 1 inch and 1 3/8 inches.
    11. The photographs may be in color or black and white.
    12. They must be full face, front view with a plain white or off-white background.
    13. Photographs should be taken in normal street attire, without a hat or headgear that obscures the hair or hairline.
    14. Uniforms should not be worn in photographs.
    15. If prescription glasses, a hearing device, wig or similar articles are normally and consistently worn, they should be worn when the picture is taken.
    16. Dark glasses or nonprescription glasses with tinted lenses are not acceptable unless required for medical reasons. A medical certificate may be required to support the wearing of such glasses in the photographs.
    17. If you choose to submit digitized photos, they must meet the same requirements of all passport photographs. In addition, digitized photographs are always produced on digital printers. Some printers will produce a photograph in which the dots are seen. Visible dots distort the image by making it look grainy. Acceptable photos have a continuous tone image that looks very photo-like.

VISA

  1. Entry visas
    1. A visa is a preliminary permit that one will need if he/she wants to enter and stay in Sweden for a short period of time.
    2. The entry visa must be entered in the passport before the arrival in Sweden.
    3. EU Member States and EEA countries have open borders among themselves. If a visa is obtained in one of these countries, one can visit any of the others as well.
    4. Sweden allows the citizens of certain countries without entry visas stay for three months. The countries are
FEES
  1. There is a fee of SEK 315 to apply for a visa to visit Sweden.
VISA AUTHORITY
  1. The Swedish embassy or consulate-general usually make a decision after checking with the other Schengen states.
  2. If the embassy/consulate-general is not sure what position to take on an application, it passes the case on to the Migration Board in Sweden for a decision.
  3. However, it is preferable that the application for visa must be submitted at least two months prior to the departure for Sweden.
    The decision of the Migration board or the embassy is not appealable. However, a request can be made to the decision-making body to reconsider the original application.
