Supreme Court's decision on criminalizing gay sex has come as a shock for not just the homosexuals but for everyone across the nation. After the refusal to review its decision on section 377 the only way left for the supporters of this cause is to stand up and talk about the cause as and when we can. Lets all stand up and support the LGBT group in the fight for their basic rights.

Please sign, share and comment in support of legalization of Homosexual Rights in India.

Smt. Meira Kumar,

Post the Decision of the High Court in the year 2009 and recognition to homosexual rights in India in a landmark judgement in Naz Foundation v. Govt. of NCT of Delhi,it was found Section 377 and other legal prohibitions against private, adult, consensual, and non-commercial same-sex conduct to be in direct violation of fundamental rights provided by the Indian Constitution. Hence, in India, consensual sex concerning two adults of the same sex was no longer a criminal offence. Post this many homosexuals openly accepted their preferences and started living together.

Though, after the decision set out by the Supreme Court, the issues that these groups were facing are back and probably worse. The situation is now same as prior the High Court ruling, for decades, the police and sometimes society at large were using the law as an excuse to harass gay men and women, who were beleaguered, blackmailed, detained and even raped but were unable to seek any protection or justice from the law. In addition, the law was also a significant impediment to fighting HIV/Aids among sexual minorities.

We all understand that it is extremely important to stop such acts as this is a direct infringement on anybody’s fundamental rights.
We, as citizens, not categorizing ourselves as gay or straight, request you to reconsider your decision as our country has always promised to be a democracy where the fundamental rights of its citizens are considered most essential.

India is the largest democracy in the world. We can\'t deny inviduals their core rights and preferences and still claim to be a democracy. This dichotomy must be put an end to! I strongly support the cause and LGBT their choice to live their lives their way!.
