Sec. 1.

Short title.

This Act shall be known as the

Illinois Pollution Prevention Act.

Sec. 10.

Definitions.

As used in this Act:


    

"Agency" means the Illinois Environmental Protection Agency.


    

"Center" means the Waste Management and Research Center.


    

"Person" means any individual, partnership, co‑partnership, firm, company, corporation, association, joint stock company, trust, political subdivision, State agency, or any other legal entity, or its legal representative, agent or assigns.


    

"Release" means emission to the air, discharge to surface waters or off‑site wastewater treatment facilities, or on‑site release to the land, including but not limited to landfills, surface impoundments and injection wells.


    

"Toxic or hazardous materials" means (i) any materials that are reported to the Agency as released in Illinois under Section 313 of the federal Emergency Planning and Community Right to Know Act of 1986; and (ii) those wastes that are reported as hazardous wastes by hazardous waste generators in Illinois.

Sec. 15.

Pollution Prevention Report.

With regard to any voluntary pollution prevention planning program, the Agency shall utilize the source reduction and recycling information required to be reported for toxic or hazardous materials to assess and report the progress of pollution prevention, on an annual basis. This reporting shall compare the source reduction and recycling activities with respect to toxic or hazardous materials for those facilities which voluntarily conduct pollution prevention to the reporting by all facilities in Illinois for toxic or hazardous materials.

Sec. 5.

Findings.


    

(a) The General Assembly finds:

(1) that significant opportunities may exist for

industry to eliminate or reduce pollution resulting from the use of toxic or hazardous materials;

(2) that such pollution prevention opportunities may

offer significant savings through reduced raw materials, insurance and pollution control costs and are likely to improve worker health and safety;

(3) that pollution prevention opportunities may not

be fully realized because (i) existing regulations focus on treatment and disposal of wastes that have already been generated, rather than reducing the use of toxic or hazardous materials at the source; (ii) existing regulations do not emphasize multimedia management of waste; and (iii) the current regulatory structure does not encourage the use of lower cost pollution prevention alternatives;

(4) that the State should actively look for lower

cost pollution prevention alternatives that provide equal or greater protection to human health and the environment and promote the use of such options as viable alternatives to current federal and State regulatory structures;

(5) that State environmental agencies can help

promote pollution prevention by disseminating information about such strategies to a range of industries, both large and small; and

(6) that some industries may require on‑site

technical assistance from the State for pollution prevention.

    

(b) The General Assembly declares it to be the policy of the State of Illinois that (i) pollution should be prevented or reduced at the source whenever feasible; (ii) when source reduction is not feasible, recycling in an environmentally safe manner should be utilized; (iii) when neither source reduction nor recycling are feasible, treatment in an environmentally safe manner should be utilized; and (iv) when treatment is not feasible, only as a last resort should disposal or other releases into the environment in an environmentally safe manner be utilized.


    

(c) It is the purpose of this Act (i) to reduce the disposal and release of toxic or hazardous materials, (ii) to promote pollution prevention as the preferred means for achieving compliance with environmental laws and regulations, (iii) to establish State programs that provide high‑level attention to pollution prevention policy initiatives, (iv) to integrate existing regulatory programs to promote pollution prevention, and (v) to stimulate pollution prevention strategies by industry.

Sec. 65.

This Act takes effect upon becoming law.
