The Seed Potato Board, established by Title 5, section 12004-H, subsection 5, and located in the Department of Agriculture,
Food and Rural Resources, shall consist of the commissioner and 8 additional members appointed by the commissioner. Of the
8 appointed members, 7 shall be chosen from representatives of the potato industry in Aroostook County and one from elsewhere
in the State, provided that one appointed member shall be primarily a table stock producer and one primarily a processor producer.

Each appointed member shall serve for a term of 3 years or until his successor has been appointed and qualified, except that
no member may serve for more than 2 consecutive terms.

div> Upon the expiration of the term of office of any appointed member of the board, said member's successor shall be appointed
by the commissioner, or in case of a vacancy for any reason, the commissioner shall appoint a member to fill the unexpired
term.

The Seed Potato Board shall meet annually on such date and at such place as the board may appoint and shall meet at such other
times as the board may deem necessary or when called by the chairman of the board or any 2 members thereof upon 2 days' notice.
The board may by resolution provide for a shorter notice made by telegraph, telephone or otherwise.
div> The presence at any meeting of at least 5 members of the board shall be necessary to constitute a quorum, and the concurring
votes of not less than a majority of the members present at any meeting shall be necessary to the decision of any question
or issue or the authorization of any action.

The Seed Potato Board shall have the power and authority to produce, or cause to be produced through contract or otherwise,
such acreages of foundation seed potatoes of various varieties as it may from time to time determine for distribution and
sale to the potato growers of this State. The commitments of the board shall not exceed in the aggregate the amount of funds
which may be made available to it. In addition, the board shall be advisory to and shall have authority to work with and through
the Maine Agricultural Experiment Station of the University of Maine System and other public and private agencies, in conducting
and carrying on a program of production of foundation seed potatoes annually. The board shall have authority to purchase,
own or otherwise acquire farm real estate and farm equipment if necessary for the purpose of producing acreages of foundation
seed potatoes or providing for the testing thereof, and any salable material resulting from the ownership or operation may
be sold to the best advantage of the board. The board shall have authority to sell or otherwise convey farm real estate and
farm equipment no longer required for the purposes of this chapter. Proceeds from the sale shall be credited to the operating
account of the board.

div> The board shall have the responsibility and full power and authority to make, in a manner consistent with the Maine Administrative
Procedure Act, rules and regulations not inconsistent with law pertaining to its program of production, distribution and sales
of foundation seed potatoes to the potato growers of the State, as it may from time to time determine, including, but not
limited to, long-range projections of industry trends and needs, contracting with growers to reproduce nuclear seed stock
normally grown at the state seed potato farm, determination of the varieties and volume of seed to be grown at the state seed
potato farm, allocation of seed to growers for the benefit of the entire state potato industry, development of a standardized
commercial seed testing programs for new varieties, if no such procedure exists under the auspices of the Maine Agricultural
Experiment Station, and to exercise any other power which may be conferred upon the board by law.

div> The board is authorized to pay to the Town of Masardis in lieu of taxes a sum, in the discretion of the board, which will
compensate the town in whole or in part for loss of real estate taxes due to state ownership of real estate now used for seed
potato purposes.

div> Notwithstanding any provision in Title 5, chapter 155, the Seed Potato Board may purchase all services, supplies, materials
and equipment required by the board to fulfill the purposes of this chapter. In addition, the board is exempt from the bidding,
contract and review procedures contained in Title 5, chapter 153 for any public improvement project with a value of less than
$10,000.

1. Administration. The Seed Potato Board shall elect a secretary, who need not be a member of the board, and the commissioner shall have authority
to employ a managing director and such agents as may be necessary, subject to the Civil Service Law, to consummate any and
all programs which it may institute, as authorized under the terms of this chapter and shall keep a record of all of its proceedings,
and all expenses by it incurred shall be paid out of the State Treasury, on certification of the commissioner, upon the audit
and warrant of the State Controller and charged against any and all appropriations which may be annually made available for
its use as stipulated. The board shall be subject to the provisions of Title 5, chapter 379.

2. Program plan. The managing director shall present to the board, at least annually, a program plan for the board's consideration and specific
action, which plan shall include an assessment of the seed potato industry, a projection of demand for seed by variety in
the various marketing areas, the impact of significant changes in seed potato acreage, the capital needs of the state seed
potato farm, considering current and future technology, proposals to improve the varieties and quality of Maine seed potatoes,
recommendations to promote the sale of Maine seed, and to other such matters the managing director deems appropriate.

1. Promotion. The Maine Potato Board shall be responsible for developing, each year, a program to promote new potato varieties.

2. Breeding. The Maine Agricultural Experiment Station shall be responsible for breeding and testing of new potato varieties.

3. Testing. The Maine Agricultural Experiment Station shall hire an agronomist to work with the Maine Potato Breeding Program in Presque
Isle to test new potato varieties. The agronomist shall be responsible for:
A. Developing the best cultural practices for new varieties;

B. Promoting new varieties of Maine seed potatoes to farmers in Maine and other areas;

C. Establishing field trials of new varieties; and

D. Monitoring the sales and performance of the new varieties.

4. Multiplication. The Seed Potato Board shall be responsible for multiplying seedstocks of advanced selections from breeding programs. The
board shall establish an isolated facility at the Porter Farm to produce a sufficient volume of pathogen-free seedstocks of
advanced selections from breeding programs, in order to:
A. Provide extensive and rigorous pathogen testing on the seedstocks introduced, cultured and multiplied in the facility;

B. Establish systematic production of pathogen-free seedstocks by meristem culture after heat therapy to free the stocks of
any infectious viruses; and

C. Provide limited increase of the pathogen-free seedstocks in the field to produce quality seed potatoes for further evaluation
by breeders and growers.

5. Challenge grants. The commissioner shall establish a challenge grant program to help in establishing field trials for new potato varieties.
Grant proposals shall be approved by the commissioner after review and recommendation by the Potato Plant Breeder at the
Maine Agricultural Experiment Station in Presque Isle, the Director of the Division of Plant Industry, the chairman of the
seed grower's executive council of the Maine Potato Board and the Director of the Seed Potato Board. Grants may be given
to farmers outside of this State. Grants may consist of seed, and assistance in determining cultural practices, and a percentage
of the farmer's production costs to be determined by the commissioner. Those receiving grants shall cooperate with the agronomist
of the Maine Agricultural Experiment Station in developing the best cultural practices and sharing production and marketing
information.

6. Reporting. The agronomist of the Maine Agricultural Experiment Station shall monitor the sales and performance of new potato varieties
and shall report annually to the commissioner and the joint standing committee of the Legislature having jurisdiction over
agriculture. The report shall summarize the field trial program and address total sales of new seedstock, adoption of new
varieties by the State's farmers, yields, quality and other indicators of performance.

7. Potato Variety Development Fund. There is established a nonlapsing Potato Variety Development Fund. The Commissioner of Agriculture, Food and Rural Resources
may accept money for this fund from the Federal Government or any public or private source and make expenditures from this
fund in order to carry out activities relative to the program. Any General Fund money appropriated for potato variety development
shall be deposited into the Potato Variety Development Fund.

8. Rules. The commissioner shall adopt rules, according to the requirements of the Maine Administrative Procedure Act, Title 5, chapter
375, for the interpretation and implementation of this section.
