§8101. Purpose

The Legislature recognizes that gifted and talented students, who comprise approximately 3% to 5% of Maine's students, require differentiated education programs that are aligned with the system of learning results as established in section 6209, beyond those normally provided by the regular school program in order to realize their educational potential and contribution to themselves and to society. §8102. Grants to school administrative units

The department may, from funds available to it, grant funds to a school administrative unit to undertake gifted education programs. A grant must be made on the basis of the requirements of the department. [2003, c. 477, §7 (amd).]

1. Guidelines for the identification of gifted and talented students. The commissioner shall adopt or amend rules for the identification of gifted and talented students and for gifted and talented education programs. [1981, c. 693, §§5, 8 (new).]


2. Programs for gifted and talented students. A school administrative unit requesting funds to undertake a gifted and talented education program shall develop a proposed program of identification and education in accordance with guidelines established by the commissioner. 3. Time limits. The following limits apply.



A. On or before June 30th, the school administrative unit shall submit to the department its proposed program. [2003, c. 477, §8 (amd).]




B. By September 1st, the commissioner shall notify the school administrative unit whether the proposal has been funded for the following fiscal year. [2003, c. 477, §8 (amd).]

4. Technical assistance. The commissioner may provide technical assistance to a school administrative unit for planning for gifted and talented education programs. [1981, c. 693, §§5, 8 (new).]

§8103. Available funds

Funds made available to the department for gifted and talented education programs from state, federal or other sources do not lapse at the end of a fiscal year, but are carried forward to the next fiscal year for a period of 90 days to be used for the purposes set forth in this chapter or for the purposes stipulated by the granting agency. §8104. School administrative units to establish programs

1. Establishment. Each school administrative unit shall, commencing with the 2004-2005 school year, fully implement its plan for phasing in gifted and talented educational programs. Beginning with the 2004-2005 school year, a school administrative unit may apply to the commissioner for a one-year waiver of this requirement if full implementation of this requirement presents an undue burden. 2. Rules. The commissioner shall amend or adopt rules to implement this section, including the identification of students, needs and resource assessment, and program planning, development and implementation. Rules adopted pursuant to this section are routine technical rules pursuant to Title 5, chapter 375, subchapter 2-A. [2003, c. 477, §11 (amd).]


3. Technical assistance. The commissioner may provide technical assistance to a school administrative unit for planning for gifted and talented education programs. [1985, c. 463, §1 (new).]
