IMMIGRATION LAW IN CUBA

VISA REQUIREMENTS

Countries Requiring Visas:

All persons entering Cuba except the following require visas:

  • Citizens of countries which have signed visa exemption agreements with Cuba;
  • Holders of a Tourist Visa Card;
  • Transit passengers continuing their journey to a third country within 72 hours provided they hold confirmed onward tickets and US $ 50 per day.

Visa exemptions and Tourist Visa Card facilities do not apply to foreign passport holders born in Cuba unless they possess a document which proves withdrawal of their Cuban citizenship.

Types of Visa, Validity and Cost:

1.     Tourist Visa Card (30 days) (₤15): This is issued for recreational purposes only. It must be used within 6 months of issue.

2.      Business Visa (30 days) (₤15): There are two types of Business Visas issued to those who travel to Cuba on business:

·        A-7: This Business visa is for exploring business possibilities in Cuba.

·        D-7: This Business visa is for engaging in business operations or transactions in Cuba.

3.     Family Visa (30 days): This visa is issued to those who have close relatives in Cuba.

4.     Diplomatic Visa: This visa is free of charge.

5.      Journalist Visa (30 days) (₤47): This is issued to journalists coming to work in Cuba.

Documents Required for Visa Application:

The following documents are required while applying for a visa:

For Tourist Visa Card:

  • One Completed Application Form;
  • Photocopy of Valid Passport;
  • Proof of travel arrangements (return tickets) and accommodation booking;
  • Fee;

For Business Visa:

  • One Completed Application Form;
  • Valid Passport;
  • Two passport-size photos;
  • Details of business contact in Cuba;
  • Letter of invitation from Cuban company, organization or institution;
  • Fee.

For Family Visa:

  • One Completed Application Form;
  • Valid Passport;
  • Two passport-size photos;
  • Fee.

For Journalist Visa:

  • Valid Passport;
  • Two Completed Application Forms;
  • Two passport-size photos;
  • A sponsor letter from the employer;
  • A written version of the applicant’s journalistic project;
  • A list of the photographic / filming equipment the applicant intends to carry;
  • Fee.

For Diplomatic Visa:

  • An official letter from the Foreign and Commonwealth Office or by a Note Verbale from the relevant diplomatic mission;
  • Valid Passport;
  • Two Completed Application Forms;
  • Two passport-size photos;
  • The Note Verbale.

CUBAN CITIZENSHIP

A person may acquire Cuban citizenship through one of the following methods:

1.     By Birth: A person born within the territory of Cuba is a Cuban citizen irrespective of the nationality of the parents.

2.      By Descent: A person acquires Cuban citizenship by descent if he is born abroad and at least one of the parents is a Cuban citizen.

3.      By Naturalization: The following persons can acquire Cuban citizenship by naturalization:

·      those who acquire Cuban citizenship as per the regulations established by law;

·       those who show legal proof of their contribution to the armed struggle against the tyranny overthrown on January 1, 1959.

·       those acquiring Cuban citizenship under an express agreement of the Council of State after being deprived of their citizenship of origin.
